As of 2025, marijuana remains illegal for recreational use in North Carolina. Possession of small amounts has been decriminalized to some extent, meaning a first offense typically results in a fine rather than jail time. However, any sale, cultivation, or possession of larger amounts can still lead to serious legal consequences.
When it comes to medical marijuana, North Carolina lags behind many other states. A comprehensive medical marijuana program has not been fully established statewide. However, there is a notable exception: the Eastern Band of Cherokee Indians, a sovereign nation within the state, has legalized medical cannabis on their land. This means patients can legally purchase medical marijuana at the tribal dispensary, but only within the Qualla Boundary.
There is growing momentum for change. In early 2025, lawmakers introduced new bills aiming to legalize and regulate cannabis for adults 21 and older. These efforts include plans for personal possession limits, home cultivation, and the expungement of past marijuana-related offenses.
For now, unless you are on tribal land under specific conditions, marijuana remains illegal in North Carolina. Still, advocates are hopeful that full legalization could be on the horizon in the next few years.
